SHERA Public Company Limited ("SHERA") warrants to the purchaser and first owner of the product (for every owner) that this product meets the ASTM C1186 standard, and warrants that the product is free of manufacturing or material defects, and is manufactured to specification within SHERA's standard tolerances — provided the product has been used for its intended purpose, correctly installed, and maintained as detailed in SHERA's installation manual. The product is warranted for a period of 30 years from the date of purchase, to be:
Termite & Insect Resistant
During the warranty period, if the product fails to meet the properties stated in this warranty, "SHERA" as the sole distributor will:
a)Replace the product, in whole or in part, with a new one;
b)If the defective product is no longer in production, the Company will replace it with the nearest equivalent new product; or
c)Refund the product price — deemed full compensation to the claimant for the damage, and settling any claim under law or arbitration, subject to the claimant's acceptance of this agreement.
If the original value of the claimant's product cannot be determined, "SHERA" will assess a reasonable value. Replacing a defective "SHERA" product or refunding its price under item 1 is deemed the sole compensation given to the claimant for the damaged/defective product. "SHERA" shall not be responsible for repair costs, installation labor, equipment, installation components, or removal costs for such repair. In no case shall "SHERA" be responsible for labor or other costs related to removal, initial installation, or repair installation. "SHERA" shall in no case be responsible for the cost of shipping a defective product back to the Company (for inspection or otherwise) or the cost of shipping a replacement product to the beneficiary.
